2.1 Digital Products All digital products, including but not limited to ebooks, online courses, and downloadable content, are non-refundable. Upon purchase, these products are considered final sales. No refunds, exchanges, or returns will be provided for digital products under any circumstances, in compliance with the Consumer Protection Act (CPA), 68 of 2008, which stipulates that digital goods, once delivered, are not subject to return.
2.2 Access to Digital Content By purchasing digital products or enrolling in courses, you agree to the following terms:
- Non-Sharing Policy: You are prohibited from sharing, distributing, or transmitting any digital content obtained from Ernestco. This includes, but is not limited to, ebooks, courses, and other digital materials. Unauthorized sharing of content violates copyright laws and Ernestco’s terms of service.
- Revocation of Access: Ernestco reserves the right to revoke access to digital products or courses if there is a breach of the non-sharing policy or any other terms of service. In such cases, no refunds will be issued, and access to the purchased content will be terminated immediately.
3. Booking Deposits and Refunds
3.1 Booking Deposits For consultations or services requiring advance booking:
- Deposit Requirement: A 50% deposit of the consultation fee is required to confirm your appointment. The deposit ensures that your booking is secured.
- Cancellation Policy: If you cancel your appointment with less than 48 hours’ notice, the deposit will be forfeited. If you provide more than 48 hours’ notice, the deposit will be credited toward a rescheduled appointment. Rescheduled appointments must be made within 30 days of the original booking.
3.2 No-Show and Late Arrivals
- No-Show Policy: Failure to attend the scheduled consultation or arriving more than 20 minutes late may result in the forfeiture of the deposit. In such cases, a new deposit may be required to reschedule the consultation.
4. Compliance with National Credit Act and Consumer Protection Laws
4.1 National Credit Act (NCA) Ernestco is committed to adhering to the National Credit Act, 34 of 2005, which regulates credit agreements and protects consumers in South Africa. While this policy primarily addresses non-refundable digital goods and services, we ensure that all financial transactions comply with NCA regulations.
4.2 Consumer Protection Act (CPA) In accordance with the Consumer Protection Act, 68 of 2008, our policy reflects the statutory requirements regarding refunds, returns, and cancellations. Digital goods are not subject to the CPA’s provisions for return and refund once the content has been delivered and accessed. We comply with CPA regulations to ensure transparency and fairness in our policies.
5. Exceptions and Special Circumstances
In rare instances where digital products or services are found to be defective or not as described, please contact us at hello@ernestco.co.za within 7 days of purchase. We will assess each case individually. Possible resolutions include providing a corrected version of the digital content or an alternative solution, but refunds or exchanges are not guaranteed.
6. General Refund and Return Conditions
6.1 No Refunds for Unauthorized Access If access to digital content is revoked due to a breach of the non-sharing policy or other terms, no refunds will be provided.
